Interest owed on a security deposit

Simple interest, set each calendar year by the Rent Adjustment Commission, on every deposit held at least one year. An owner may instead pay the actual interest the bank paid on the deposit, and must then hand the tenant the bank statement showing it. During the tenancy you pay the accrued interest either as a direct payment or as a credit against rent: LAMC §151.06.02(C) says you choose one of the two and must tell the tenant your choice in writing, and you may pay monthly or yearly. When the tenancy ends, §151.06.02(D) sends any unpaid accumulated interest back at the same time and in the same manner as the deposit itself. The RSO does not require deposit interest on mobile home park spaces. §151.06.02(D), read verbatim in the city's code library (2026 Rev. 8 compilation) on August 9, 2026, sends unpaid accumulated interest back ‘at the same time and in the same manner as required for return of security deposits in California Civil Code Section 1950.5(f)’. That cross-reference is stale in the code's own text: since January 1, 2026 (AB 414) the 21-day return-and-itemize provision is §1950.5(h), and (f) is the pre-move-out inspection. The rule is unchanged: same time, same manner as the deposit. Only the subdivision letter moved.

We read the full text of RSTPO Chapter 8.52 and found no deposit-interest provision. DCBA's own security deposit page says state law does not require interest and that the county's rule for fully covered units is a bar on raising the deposit during the tenancy, not an interest requirement. Deposit handling otherwise follows Civil Code §1950.5, which has no interest requirement.

The Board's Security Deposits information sheet says "Rent Control regulations do not require an owner to pay tenant interest on their security deposit," and its FAQ says "Current Rent Control regulations do NOT require owners to pay interest on security deposits." Santa Monica has no local deposit-interest rule.

"The current security deposit interest rate is 4.3%. Interest is due in January 2026 for security deposits held during 2025." The city sets the rate each year and interest is owed to the tenant by January 31. Pay it: a tenant who has not been paid may deduct what they are owed from their rent from February 1. That deduction is the tenant's remedy, not a way for you to settle it.

Charter §1806(f), through PRHB Regulations Chapter 10, requires interest to be paid each year on every tenant security deposit held for at least one year, at a rate the Rental Board sets annually. The Board surveys at least five FDIC banks with Pasadena branches on their October 1 savings rates, averages them, and adopts the figure by November 1 for the following calendar year.

Not required by state law
A verified negative. Civil Code §1950.5 is the whole of the state's residential deposit law and it contains no interest requirement anywhere in its text. Some cities do require it. LA City and West Hollywood are the ones in our coverage area that we have confirmed.
"Not required" is a finding, not a gap. We read the ordinance, it has no deposit-interest rule, and the document is in the row. Rates reset each January, and some cities let you pay the actual bank interest instead. Work out what you owe.
